Women who cannot have a child for medical reasons need a surrogate mother to fulfil their desire to have a child. Most of the time, the egg and sperm cells come from the couple who wish to have a child, and the surrogate mother has the embryo placed into her uterus.
Surrogacy is prohibited in Austria according to Sections 2 and 3 of the Reproductive Medicine Act (Fortpflanzungsmedizingesetzes). According to Section 143 of the General Civil Code (Allgemeines Bürgerliches Gesetzbuch), the mother of a child is the woman who gave birth to the child.
